T&C FOR THE PURCHASE AND REDEMPTION OF PASSES FOR THE WINTER SEASON 2024/2025 OF THE OPERA IN CINEMA
1. Definitions:
A. Issuer or Cinema City – Cinema City Poland Sp. z o.o., with its registered office in Warsaw at ul. Fosa 37, 02-768 Warsaw, registered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw, XIII Economic Department, under the number KRS 0000707019, NIP 521-30-97-055, website address: www.cinema-city.pl (hereinafter: Website), email address: [email protected], hereinafter also referred to as "Cinema City."
B. Pass – a virtual gift card (graphic document), purchased via the Website, which entitles the User to redeem it for Tickets at a Cinema City cinema or via the website www.cinema-city.pl. Each Pass contains a unique code. The Pass can only be used in Cinema City cinemas.
C. User – any holder of the Pass.
D. Ticket – a document confirming the right to participate in a film screening at a Cinema City cinema.
E. Website – the Issuer's website – www.cinema-city.pl
F. Service Fee – an additional fee of PLN 2.00 for each Ticket, paid by the User when redeeming the Pass for a Ticket via the Website, unless the type of Card in question includes this service fee.
G. Region 1 – Warszawa Arkadia, Warszawa Promenada, Warszawa Sadyba, Kraków Bonarka, Kraków Kazimierz, Łódź Manufaktura i Wrocław Wroclavia.
Region 2 – Poznań Plaza, Bydgoszcz, Gliwice, Katowice Punkt 44, Toruń Czerwona Droga, Bielsko-Biała, Zielona Góra, Częstochowa Jurajska, Lublin Plaza.
2. By purchasing and using the Pass, the User declares that they have read these terms and conditions, understand their content, have no objections to them, and agree to abide by them.
3. The Pass can be purchased via the Website. The Pass is purchased after the User fills out the purchase form on the Website, providing accurate data necessary to complete the purchase and after accepting the Cinema City Regulations, including these terms. The Pass is sent immediately after Cinema City receives payment for the selected type of Pass, to the email address provided by the User when filling out the order form.
4. Cinema City sells Passes that can only be redeemed in selected cinemas in specified Regions.
5. The Region in which the Pass can be redeemed must be selected before making the purchase.
6. A Pass purchased for Region 1 is valid in the following cinemas: Warszawa Arkadia, Warszawa Promenada, Warszawa Sadyba, Kraków Bonarka, Kraków Kazimierz, Łódź Manufaktura i Wrocław Wroclavia.
7. A Pass purchased for Region 2 is valid in the following cinemas: Poznań Plaza, Bydgoszcz, Gliwice, Katowice Punkt 44, Toruń Czerwona Droga, Bielsko-Biała, Zielona Góra, Częstochowa Jurajska, and Lublin Plaza.
8. The VIP Pass is valid only in VIP halls at Bonarka in Kraków and VIP Wroclavia in Wrocław.
9. Cinema City reserves the right to sell other types of Passes, the scope of which will be described in a separate regulation.
10. Before the screening, the Pass must be exchanged for Tickets:
- at the Cinema City box office, or
- on the Website (cinema-city.pl).
11. The basis for using the Pass is its code, which means that the Customer is obligated to protect the Pass code and not share it with third parties, including in the form of a photo. If the code on the Pass is illegible or has already been used (as registered in the system), the Pass will not be accepted by Cinema City staff.
12. All Passes include a service fee.
13. The possession of a Pass does not guarantee the ability to purchase a Ticket for a specific screening. Ticket purchase depends on seat availability in the cinema.
14. Cinema City sells the following types of Passes:

- The prices of each type of Pass can be found in the price list on the website at https://www.cinema-city.pl/opera
- Once the Pass has been exchanged for a Ticket, there is no option for a refund or exchange of the Ticket.
- The Normal Pass is valid for the operas in the winter season of 2024/2025 of the Opera in Cinema series: Tosca, Otello, Macbeth, The Elixir of Love, The Tales of Hoffmann. The Pass can be exchanged for only 1 Ticket per opera. There is no possibility to exchange the Pass for more than 1 Ticket per opera. The Pass is valid only in standard cinema halls at selected locations, not in VIP halls, and includes a service fee.
- The Reduced Pass is valid for the operas in the winter season of 2024/2025 of the Opera in Cinema series: Tosca, Otello, Macbeth, The Elixir of Love, The Tales of Hoffmann. The Pass can be exchanged for only 1 Ticket per opera. There is no possibility to exchange the Pass for more than 1 Ticket per opera. The Pass is valid only in standard cinema halls at selected locations, not in VIP halls, and includes a service fee. It applies to students, youth, and pensioners. Eligible individuals must present appropriate identification to verify the discount.
- The VIP Normal Pass is valid for the operas in the winter season of 2024/2025 of the Opera in Cinema series: Tosca, Otello, Macbeth, The Elixir of Love, The Tales of Hoffmann. The Pass can be exchanged for only 1 Ticket per opera. There is no possibility to exchange the Pass for more than 1 Ticket per opera. The Pass is valid only in VIP cinema halls at Kraków Bonarka and Wrocław Wroclavia, and includes a service fee.
- The VIP Reduced Pass is valid for the operas in the winter season of 2024/2025 of the Opera in Cinema series: Tosca, Otello, Macbeth, The Elixir of Love, The Tales of Hoffmann. The Pass can be exchanged for only 1 Ticket per opera. There is no possibility to exchange the Pass for more than 1 Ticket per opera. The Pass is valid only in VIP cinema halls at Kraków Bonarka and Wrocław Wroclavia, and includes a service fee.
- Passes are not valid for special events or screenings such as marathons, Ladies' Night events, concerts, or other special performances.
- Passes cannot be combined with other promotional offers from Cinema City or its partners, unless otherwise stated.
- There is no option to add funds to a Pass for purchasing a Ticket for events not specified on the Pass.
- The Passholder can give the Pass to a third party free of charge.
- When passing the Pass to a third party, the Passholder must inform the new User of the rules for using the Pass as stated in these regulations.
- Cinema City is not responsible for the failure to inform the third party about the terms of using the Pass.
- The Passholder is not allowed to resell the Pass without prior written consent from Cinema City.
- In case of complaints regarding the Pass, a proof of purchase must be presented.
- It is not possible to exchange the Pass for cash or to issue a duplicate.
- The User has the right to withdraw from the purchase agreement of the Pass (purchased remotely) within 14 days without providing any reason. The withdrawal period expires 14 days after the purchase of the Pass. To exercise the right of withdrawal, the User should inform the Issuer of their decision to withdraw from the agreement by sending an unequivocal statement via email to [email protected] or by traditional mail to Cinema City Poland Sp. z o.o., ul. Fosa 37, 02-768 Warszawa. To meet the withdrawal deadline, it is sufficient for the User to send the information regarding the exercise of their right to withdraw from the agreement before the withdrawal period expires. In the event of withdrawal from this agreement, we will refund all payments received from the User without delay, and in any case, no later than 14 days from the day Cinema City was informed of the decision to exercise the right of withdrawal. Cinema City will make the refund using the same means of payment that were used by the User in the original transaction, unless the User agrees to a different solution; in any case, the User will not incur any fees in connection with this refund. For the avoidance of doubt, the right of withdrawal does not apply in the case of the Pass being used, i.e., the exchange of the Pass for a Ticket.Cinema City is not responsible for loss, destruction, or theft of the Pass. No duplicates will be issued.
- Cinema City is not responsible for the loss, destruction, or theft of the Pass. In the event of losing the Pass, a duplicate will not be issued.
- The Pass is valid until the last opera screening of the 2024/2025 winter season, on March 16, 2025.
- It is not possible to extend the validity of the Pass.
- The current repertoire is available on the website www.cinema-city.pl
- The administrator of Users' personal data is Cinema City. The processing of Users' personal data will take place in order to enable Cinema City to provide the services and deliver the goods specified in these terms and conditions, as ordered by the User. Personal data may also be processed to improve Cinema City’s products and services, to carry out marketing activities for its own products and services, and to protect Cinema City’s rights, particularly against claims, based on the so-called legitimate interests of the administrator, which include the aim of developing and promoting Cinema City’s services. Personal data may also be processed for other purposes, based on the User's separate consent, according to the scope specified in the content of that consent each time.
The processing of data is based on Article 6(1)(a) (User's consent), (b) (actions necessary to perform the service), and (f) (legitimate legal interest of the Administrator) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "GDPR"). Providing personal data is voluntary, but in some cases, necessary for the performance of the Agreement (e.g., for the delivery of the Pass).
Each individual whose data is processed has the right to request access to the data, its correction, deletion, or restriction of processing, the right to object to processing, the right to lodge a complaint with the supervisory authority—the President of the Office for Personal Data Protection—as well as the right to data portability. In cases where processing is based on consent, the User has the right to withdraw that consent at any time without affecting the legality of the processing that was carried out based on the consent before its withdrawal.
The data will be stored for the duration of the Agreement and after its termination until the expiration of the limitation period for any claims arising from the Agreement, in accordance with the provisions of the Civil Code. The Administrator has appointed a Data Protection Officer, who can be contacted via email at [email protected] or by mail at ul. Fosa 37, 02-768 Warsaw.
