TERMS AND CONDITIONS OF PURCHASE AND USE OF THE UNLIMITED GIFT CARD

Issuer - Cinema City Poland Sp. z o.o. with its registered office in Warsaw, ul. Fosa 37, 02-768 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, under number
KRS 0000707019, NIP 521-30-97-055, issuing the Gift Card;
Cinema City Cinemas - all Cinema City cinemas in the Territory of the Republic of Poland;
Gift Card - a plastic or virtual card issued to the bearer, having a Promotional Code, entitling the User to register in the Unlimited program on the Cinema City website;
Physical Card - a type of plastic gift card purchased at Cinema City Cinemas;
e-Card - a type of virtual gift card purchased via the Website;
Buyer - a person who acquires a Gift Card from the Issuer;
User - the Buyer or other Gift Card holder who registers in the Unlimited program using the Gift Card;
Website – Issuer’s website available at www.cinema-city.pl
Unlimited - a program functioning as part of the Issuer's activity enabling the User, in connection with having an appropriate unlimited card, to enter Cinema City Cinemas in accordance with the Unlimited Regulations;
Unlimited Regulations - Unlimited Regulations available at www.cinema-city.pl/regulamin-unlimited
Regulations - these terms and conditions of purchase and use of the unlimited gift card
- The Issuer undertakes to provide the Buyer with a Gift Card and enable its implementation at www.cinema-city.pl/unlimited/rejestracja.
- The Physical Card may be purchased and handed over to the Buyer only at Cinema City Cinemas
- The e-Card may be purchased via the Website. E-Card is purchased after the Buyer completes the purchase form, including providing true data necessary to make a purchase, and after acceptance of the Regulations. The e-Card shall be sent immediately after receipt by Cinema City of payment for the selected type of e-Card to the e-mail address provided by the Buyer when filling in the order form.
- The Buyer undertakes to pay the nominal value of the Gift Card, whereby payment can be made in cash or using a payment card (in the case of purchasing a Physical Card at Cinema City Cinemas) or using the available payment methods (in the case of purchasing an e-Card via the Website).
- The Gift Card is activated within 24 hours of purchase by the Buyer (when purchasing a Physical Card at Cinema City Cinemas) or immediately (when purchasing an e-Card via the Website).
- The Gift Card is valid and active for a period of 6 months from the date of purchase. It is not possible to extend the validity of the Gift Card.
- The Gift Card after exceeding the deadline referred to in point 6 of the Regulations expire and it is not possible to reactivate it. Gift cards purchased between November 24 and December 31 are valid for 12 months from the date of purchase. The expiry of the Gift Card will prevent its validity and registration in the Unlimited program.
- Gift Cards are issued only to the bearer. The Buyer of the Gift Card is entitled to transfer the Gift Card to a third party free of charge.
- The unique scratch card code, placed on the reverse of the Physical Card or the e-Card number, is a type of Promotional Code and can be used by the User to register in the Unlimited program. It is a non-cash form of payment for the annual Unlimited subscription.
- 10. There are two types of Gift Cards available. The type of gift card is defined by the symbol on the reverse (in case of Physical Card) or type of e-Card:
- BW symbol (in case of Physical Card) or Karta Podarunkowa Unlimited G2 (in case of E-card) – enable the user to register in the Unlimited program when selecting Unlimited Subscription Group 1 or 2
- WA symbol (in case of Physical Card) or Karta Podarunkowa Unlimited G3 (in case of E-card) - enable the user to register in the Unlimited program when selecting Unlimited Subscription Group 1,2 or 3.
- Prices of particular types of Gift Cards are available at www.cinema-city.pl/unlimited-gift-card.
- The Physical Card purchased at Cinema City Cinemas is not refundable or exchangeable for cash.
- The Buyer has the right to withdraw from the e-Card purchase agreement (Gift Card purchased remotely) within 14 days without giving any reason. The period for withdrawal from the agreement expires after 14 days from the date of receipt of the e-Card. In order to execute the right to withdraw from the agreement, the User should inform the Issuer of his decision to withdraw from the agreement by a statement sent to the e-mail address [email protected] or by traditional mail to the address of Cinema City Poland Sp. z o.o., ul. Fosa 37, 02-768 Warsaw. The Buyer may use the model withdrawal form available here, but this is not mandatory. In order to comply with the withdrawal period, it is sufficient for the Buyer to send information on the exercise of his right of withdrawal before the expiry of the withdrawal period. In the event of termination of this agreement, Cinema City shall return all payments received as soon as possible, and in any event no later than 14 days from the date on which Cinema City was informed of the decision to exercise the right to withdraw from the agreement. Cinema City will refund payments using the same payment methods as those used by you in the original transaction, unless you agree otherwise, and in any case you will not be charged any fees in connection with the refund. For the avoidance of doubt, the right of withdrawal does not apply to the redeemed Gift Card, i.e. after registration for the Unlimited program using a Promotional Code from the Gift Card.
- The Issuer is not responsible for the use of a Gift Card by a third party, as well as for the loss or damage of a Gift Card for a reason not attributable to the Issuer after its delivery to the Buyer.
- All complaints related to the purchase and use of Gift Cards will be considered by the Issuer within 14 (fourteen) days from the date of the written complaint by the Buyer or User.
- Complaints regarding the Gift Card may be submitted in writing directly at Cinema City Cinemas during their opening hours or sent by e-mail to [email protected]. In case of the Gift Card complaint, a proof of purchase must be presented.
- Purchase of the Gift Card by the Buyer means acceptance of the content of these Regulations and the obligation to comply with it. Cinema City shall not be liable for the Buyer's failure to provide the User with the information specified in the Regulations, among others, and the Buyer is obliged to inform the User that the Gift Card:
- can only be used for registration in the Unlimited program;
- cannot be exchanged for cash;
- has an expiry date, after which it cannot be used.
- The promotional code can be used by the User, provided that he meets and accepts the conditions set out in the Unlimited Regulations and accepts the Terms of Use of the Promotional Code located at www.cinema-city.pl/regulamin-kodow-unlimited.
- In the event of withdrawal or termination of the Unlimited contract, for which payment was made in full using the Promotional Code purchased on the basis of a separate contract concluded between the Buyer of the Promotional Code and Cinema City, the User shall not be entitled to refund of the annual subscription fee.
- A Gift Card within the meaning of applicable law is not an electronic payment instrument. The Gift Card is a form of cashless payment for the Unlimited subscription at www.cinema-city.pl/unlimited/rejestracja.
- The Controller of Users' personal data is Cinema City. The processing of your personal data shall be for the purpose of enabling Cinema City to provide the services and goods specified in these terms and conditions and ordered by you. Personal data may also be processed for the purpose of improving Cinema City's products and services, marketing its own products and services, and protecting Cinema City's rights, in particular against claims – on the basis of the Controller's legitimate interest in developing and promoting Cinema City's services. Personal data may also be processed for other purposes, on the basis of a separate consent of the User, in accordance with the scope of each time specified in the content of the consent. Processing of data is based on Article 6(1)(a) (consent of the User), (activities necessary for the performance of the service) and (legitimate legal interest of the Controller) of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("GDPR"). Providing personal data is voluntary, in some cases necessary for the implementation of the Agreement (e.g. for the delivery of the e-Card). Every data subject has the right to demand from the Controller access to the Data, correct, delete or limit the processing, the right to object to the processing, the right to lodge a complaint to the supervisory authority - the President of the Office for the Protection of Personal Data, as well as the right to transfer the data. If the processing of data is based on consent, the User has the right to withdraw it at any time without affecting the lawfulness of the processing which was carried out on the basis of consent prior to its withdrawal. Data will be stored, for the duration of the Agreement and after its termination, until the expiration of the statute of limitations of any claims under the Agreement in accordance with the provisions of the Civil Code. More information about the principles and basis of personal data processing is specified in the Privacy Policy.
- The content of these Regulations is available on the Website and in Cinema City Cinemas. At the User's request, the Issuer shall provide the User at Cinema City Cinema with the content of these Regulations in writing.
