Terms and Conditions - RECOMMEND UNLIMITED offer (OFFER TERMINATED)

Any wording used in these terms and conditions of the offer and written with a capital letter has the meaning assigned to them in the Terms and Conditions of Cinema City Unlimited Regulations (https://www.cinema-city.pl/regulamin-unlimited; hereinafter: Regulation).

Organizer: with the registered office at Fosa 37, 02-768 Warsaw, entered in the Business Register of the National Court Register kept by the District Court for the capital city of Warsaw, XIII Commercial Department, under KRS No. 0000707019, NIP 521-30-97-055,
Offer: an offer described below, allowing Users to get free month of Unlimited membership for any successful Unlimited recommendation,
User: an Unlimited Card user, who has an active Unlimited membership, which is valid and fully paid at the time of the Recommendation,
Friend: a person who does not have an active Unlimited membership, who joins Unlimited program, using the User's Referral Code,
Free Month: a month when the monthly subscription fee for the Unlimited service is not charged, Recommendation: any successful registration for Unlimited program, associated with User's Referral Code, Referral Code: a unique Offer code, generated and assigned to the User Unlimited account, which is used by a Friend during Unlimited registration,
Unlimited: a subscription program offered by Cinema City, concerning the use of an Unlimited Card, Subscription Period: The first and each following 12-month Unlimited membership period from the date of registration,
Unlimited Terms and Conditions – terms and conditions defining the terms of the purchase and/or use of an Unlimited Card https://www.cinema-city.pl/regulamin-unlimited,
Online Account – an individual online account of the User, enabling the User to apply for a Referral Code, available at https://www.cinema-city.pl/unlimited/login.

1. The "Recommend Unlimited" is open to existing Unlimited members whose accounts are valid and fully paid at the time of the Recommendation and who have an active Online Account on the Cinema City website.
2. User will qualify for the Free Month if the Friend (a) joins the Unlimited Program in accordance with the Unlimited Terms and Conditions, (b) successfully completes the registration and application process for an Unlimited Card using the User’s Referral Code, and (c) has successfully paid for and remained with the Unlimited program for the first 3 months from the date of registration.
3. Friend, who registers for the Unlimited using a User’s Referral Code is automatically qualified for a Free Month. The Free Month will be granted provided that the Unlimited Agreement concluded by him will be valid for a minimum period of 12 months from the date of joining the Unlimited program, subject to the Payment Plan selected, i.e.
   1. when Monthly Payment Plan is selected, the 13th month of membership is free,
   2. when Annual Payment Plan is selected, the 14th month of membership is free. User need to renew Unlimited membership (after Annual Membership expired) for following subscription period by changing payment plan to monthly. Changing the payment plan requires User to pay for the 13th month of using the Unlimited card, by charging payment card associated to Unlimited account.
4. The Free Month will be credited automatically to the User's account,
   1. within 6 weeks of User’s Friend successfully paying for and completing the third month of the membership,
   2. after first 12 months of membership from the date of registration, subject to the Payment Plan selected and section 16 of these Regulations:
      1. when Monthly Payment Plan is selected, the 13th month of membership is free,
      2. when Annual Payment Plan is selected, the 14th month of membership is free. User need to renew Unlimited membership (after Annual Membership expired) for following subscription period by changing payment plan to monthly. Changing the payment plan requires User to pay a for the 13th month of using the Unlimited card, by charging payment card associated to Unlimited account).
   Free months gained will be canceled if:
   1. The User’s Unlimited Card will be suspended due to any payments missed
   2. The User’s payment card associated with Unlimited account is inactive or expires. The User can update the data by logging in to online account on the https://www.cinema-city.pl/konto#/zaloguj. The user should ensure that the data provided to Cinema City is up to date. In subsequent Subscription Periods, which will take place after the end of the free membership period, in accordance with the Monthly Payment Plan, the User's debit or credit card will be re-charged for subsequent months from the conclusion of the Agreement.
   Please note: If your Unlimited Card will be suspended or your payment card associated with your Unlimited account is inactive or expires, you will lose the free months gained by recommending friends.
5. In case that the User is entitled to more than one Free Month, each Free Month will be awarded in accordance with clause 4 above, and in the event that several effective Recommendations have been processed at the same time, Free Months will be allocated in the following months of membership.
6. The User will receive an e-mail from Cinema City confirming the registration by a Friend using the User's Referral Code. The user should ensure that the contact details provided to Cinema City are up to date.
7. All outstanding balances in the User's accounts must be fully paid before the Free Months are accrued and applied.
8. The Free Month cannot be applied retroactively, cannot be exchanged for cash, cannot be transferred and cannot be used to reduce outstanding fees due from Users or Friends that are required by Cinema City. Termination of the User's Unlimited Agreement (for any reason) or deactivation of the Unlimited Card will result in the loss of the accrued Free Months.
9. Free Months that have been accumulated by the User but which have not been used will not be accrued and cannot be exchanged for cash if the User's Unlimited Agreement has expired or has been terminated for any reason.
10. The User’s Referral code will be valid for an unlimited number of uses. However, User may only be awarded and benefit from a maximum of 12 Free Months each year, even if the Referral Code has been used successfully more than 12 times in that period. In such case, free Months do not pass to subsequent Subscription Periods.
11. The Referral Code cannot be sold, shared in exchange for any value or benefit, or posted for use on social media or any public website. In the event that Cinema City obtains information about the sale of the code by the User, any Free Months gained both the User’s and the Friend’s Free Months will be removed.
12. The Offer is only available in conjunction with the Unlimited registration available online at https://www.cinema-city.pl/start-unlimited, and Friends must use the User's Referral Code provided..
13. The offer is not available in conjunction with any other offer.
14. Cinema City reserves the right to change or withdraw the Offer at any time and without notice. These terms and conditions may be changed by Cinema City at any time and without notice. Changes to the Offer will only apply to new Recommendations occurring after such changes have been made. Before using or making available the Referral Code, please read the Offer.
15. The terms of the Unlimited Terms and Conditions and the Privacy Policy will apply to all new Users introduced as part of the Offer.
